Terms of Service

1. Acceptance

By creating an account or using the Fynmerge platform (“Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Fynmerge is a financial management platform for UK sole traders and small businesses. It provides cash flow forecasting, invoicing, tax deadline tracking, and financial integrations. The Service is provided “as is” for information purposes only and does not constitute financial, tax, or legal advice.

3. Account responsibilities

You are responsible for:

• Maintaining the security of your account credentials.
• All activity that occurs under your account.
• Ensuring the accuracy of financial data you enter or sync.
• Complying with all applicable UK tax and financial regulations.

4. Acceptable use

You must not use the Service to:

• Violate any applicable law or regulation.
• Submit fraudulent, misleading, or inaccurate financial data.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to access another user's account or data.

5. Subscription and billing

Paid plans are billed monthly in advance. Prices are in GBP and exclude VAT where applicable. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.

6. Data and intellectual property

You retain ownership of all financial data you upload or sync to the Service. You grant Fynmerge a limited licence to process that data solely for the purpose of providing the Service. All software, design, and content of the Fynmerge platform remains the intellectual property of Fynmerge Ltd.

7. Limitation of liability

To the maximum extent permitted by law, Fynmerge shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any loss arising from reliance on cash flow projections or tax estimates provided by the platform. Our total aggregate liability shall not exceed the fees you paid in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your account if you breach these Terms or if we are required to do so by law. On termination, your data is retained for 90 days and then permanently deleted, subject to statutory retention obligations.

9. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
